Payment Policy

All payments must be made before the contracted service date. We will not require any credit card information or imprints of credit cards. You may pay through a secure link, if you choose to pay through credit/ debit card.

Refund Policy

On cancellation of an event/ booking by the customer 14 days before the date of the ride, we will charge 20% cancellation & admin fee for the full amount of the ride.
For any event/ booking scheduled within 14 days of the event date, the deposit amount and balance amount are not refundable in the case of cancellation.

Refund will be processed within two working days from the date of cancellation.

Deposit Policy

Until an initial deposit is made, vehicles cannot be guaranteed. Deposits & balance payment is refundable subject to the refund policy.

Modifictions

No requests for cancellations or modifications can be made via phone call. Cancellations or modifications must be made via email to [email protected] only! Happiness on Wheels LLC (How) cannot guarantee any changes in schedule or time after the original time block has been reserved. In the event of a modification to the original booking, a 20% admin fee will be charged.

Client Safety

The client or anyone traveling with the client in the vehicle under this Contract shall remain inside of the passenger cabin at all times while the vehicle is in motion and shall not stand or hang out of the sunroof or windows. If Client stands or hangs out of the sunroof or window, Client shall pay a fine immediately to Happiness on Wheels LLC (How). The fine amount shall be determined by Happiness on Wheels LLC (How). Happiness on Wheels LLC (How) will not be responsible for any injuries that may occur due to horse playing while the vehicle is in motion or at a standstill or entering and exiting the vehicle. The Client is responsible for the behavior, actions, and damages caused by any guests or individuals of the Client permitted by the Client to join in using the rental vehicle.

Vehicle Damage

The clients of this reservation will be held responsible for any damages to the contracted vehicle by themselves or individuals that they allow into the contracted vehicle. Happiness on Wheels LLC (How) reserves the right to terminate service with no refund to the client(s) renting the service act in a disorderly or violent manner. There is a minimum sanitation charge of $300.00 for any stains or fluids spilled resulting from illness inside our vehicles. Happiness on Wheels LLC (How) reserves the right to initiate collection proceedings for all service or damage fees that are not paid within 14 days after the date of service. Happiness on Wheels LLC (How) will collect and all attorney’s fees, collection expenses, and court costs incurred by Happiness on Wheels LLC (How) in its effort to collect the balance owed.

Smoking/ Alcohol Policy

All vehicles are non-smoking. There is a $125 charge per occurrence. Happiness on Wheels LLC (How) reserves the right to terminate service with no refund if passengers are smoking. A driver will pull over and stop to allow passengers to smoke outside the vehicles if needed. The use of illegal drugs in our vehicles is prohibited and can result in the termination of service without a refund. Alcohol consumption is not permitted in the company of minors or by minors.

Confidentiality

Happiness on Wheels LLC (How) will not at any time or in any manner, either directly or indirectly, use for the personal benefit of Happiness on Wheels LLC (How) or divulge, disclose, or communicate in any manner, any information that is proprietary, personal or compromising to Client. Happiness on Wheels LLC (How) will protect such information and treat it as strictly confidential. This provision will continue to be effective after the termination of this Contract.

Remedies

In addition to any other rights a party may have available according to law, if a party defaults by failing to substantially perform any provision, term, or condition of this Contract (including without limitation the failure to make a monetary payment when due), the other party may terminate the Contract by providing written notice to the defaulting party. This notice shall describe in sufficient detail the nature of the default. The party receiving such notice shall have 1 day from the effective date of such notice to cure the default(s). Unless waived by a party providing notice, the failure to cure the default(s) within such period shall result in the automatic termination of this Contract.

Force Majeur

If the performance of this Contract or any obligation under this Contract is prevented, restricted, or interfered with by causes beyond either party’s reasonable control (“Force Majeure”), and if any party is unable to carry out its obligations, it must give the other party prompt written notice of such event, then the obligations of the party invoking this provision shall be suspended to the extent necessary by such event and a full refund will be issued to the client. The term Force Majeure shall include, without limitation, acts of God, plague, epidemic, pandemic, outbreaks of infectious disease, or any other public health crisis, including quarantine or other employee restrictions, fire, explosion, vandalism, storm, or other similar occurrence, orders or acts of military or civil authority, or by national emergencies, insurrections, riots, or wars, or strikes, lockouts, work stoppages, or other labor disputes, and supplier failures. The excused party shall use reasonable efforts under the circumstances to avoid or remove such causes of non-performance and shall proceed to perform with reasonable dispatch whenever such causes are removed or ceased. An act or omission shall be deemed within the reasonable control of a party if committed, omitted, or caused by such party, or its employees, officers, agents, or affiliates. A full refund will be issued to the client.

Entire Contract

This Contract contains the entire contract of the parties, and there are no other promises or conditions in any other contract whether oral or written concerning the subject matter of this Contract. This Contract supersedes any prior written or oral contracts between the parties.

General Additional Policy

  1. Happiness on Wheels LLC (How) reserves the right to substitute vehicles in the event of a vehicle malfunction or additional scheduling conflict.
  2. Happiness on Wheels LLC (How) does not refund for unforeseen traffic delays that could impact the timing of the client’s itinerary.
  3. Happiness on Wheels LLC (How)reserves the right to not perform service if weather is inclement and could jeopardize the safety of passengers and chauffeurs.
  4. All Happiness on Wheels LLC (How) drivers, contractors, sub-contractors, vendors, etc. have the authority to determine if vehicles can safely enter a narrow driveway or make tight turns.
  5. Happiness on Wheels LLC (How)is not responsible for additional time that may be incurred due to taking the alternate routes.
  6. Happiness on Wheels LLC (How) is also not responsible for delays caused by adverse weather conditions, states of emergency, accidents, or detours while a ride is in progress. Clients should allow a reasonable amount of buffer time within their schedule. 
  7. Happiness on Wheels LLC (How)cannot be held responsible for a start delay of under fifteen minutes.
  8. You agree you will not slander Happiness on Wheels LLC (How)anywhere on any social media site.
  9. For safety purposes, clients and their respective parties cannot walk in the vehicles while the vehicle is in motion.
  10. Clients and their respective parties are not to touch or attempt to open safety hatches on the vehicles except in the case of an accident or relevant emergency. 
  11. Happiness on Wheels LLC (How)will not be held responsible for any injury sustained if the vehicle must come to an immediate stop. 
  12. It is requested that the itinerary be completed on the forms provided.  Happiness on Wheels LLC (How)will not refund or reimburse clients if the driver is redirected to a route that deviates from the driver’s GPS or mapping and time is lost.
  13. Happiness on Wheels LLC (How)will not refund or reimburse clients for time lost if the driver needs to find additional addresses not included on the original itinerary.
  14. This contract must be signed and returned before the date of service.
  15. Kegs, coolers, popcorn, chips, and glass beer bottles are prohibited in the cabin of the vehicle. Coolers can be stored in the storage areas or trunks of the vehicle if there is ample space.
  16. Happiness on Wheels LLC (How)is well maintained, however, failure of the DVD, TV, iPod, or stereo system to work during service may result in a refund not to exceed a total of $50.
  17. Please check the vehicle upon exit to make certain that items of value are not left behind. Personal belongings are ultimately the responsibility of the client or their owner.
  18. No sexual activity allowed in the vehicle, $700 sanitation fee, and termination of the ride without refund if not followed.
  19. The sanitation fee is $300 in the event of vomiting.

Signatories

This Agreement shall be signed on behalf of Client by Client, Customer, and on behalf of Happiness on Wheels LLC (How) by Manager Booking effective as of the date when signed by both parties.
